Mental harassment

Hello Sirs,

I am Jinka Narayana, working as JTO in BSNL,my work place is Udaipur,Lahaul&Spiti district, under Kullu SSA in Himachal Pradesh.According to HP Govt. My work place is a tenure area.My tenure has been completed by 10-08-2012.But I didnot get transfer.Almost seven subordinates who completed tenure have got transfer order on 06-08-2012,only my name was not included in the list.My union approached the Telecom District Manager, he says we will see after 15-09-2012.But i listened that from 14-09-2012 election code will be implemented in the Himachal Pradesh due to assembly elections and election results would be announced on 15-11-2012.But every year from 15th November Hp Govt. close the road to Lahaul&Spiti district since it is snow bound area for six months.

Second one is from 11-04-2011 to 20-04-2011 i went on EL, on 24-4-2011 I have sent telegram to my SDE and DE to extend my EL because of health problem.But at the end of April month my salary was stopped.I have submitted medical from 21-04-2011 to 03-05-2011but I have joined my duty on 10-05-2011 because my journey took seven days from Andhra Pradesh to my work place,at that time road was closed and  I had to walk on snow for 12 KM.But even then my salary was not released,my DE said that submit the medical which includes journey period.So that I contacted same doctor to provide me the medical certificate which includes journey period.I submitted second medical. After that DE says you have submitted two medicals and there no genuinity on medical and he recommended for service break for seven days.I approached Telecom District Manager, he is torturing me verbally and not giving the salary because I made RTI on how they stopped my salary for that i didnot get any genuine answer.Along with that my SDE and DE  torturing me verbally and giving memo.s regularly. I approached CGM through union in writen immediately on 28-11-2011 my salary upro 03-05-2011 has been released mental torture has been reduced but they are not releasing seven days salary till  now.TDM time passing like asking explanation regarding DE proposal about my service break .

Like that I have too many irritations from SDE.I do have writen memo.s which are illegal.

Till now they are searching faults on me to point out and shouting one, SDE regularly try to shout on me for others mistake and they have given me keylong sub division JTO work because there is no JTO at Keylong sub division since one year.Even then I am not refusing the work.But now they are not giving me transfer as I have child i want to leave this area in the winter here temperature comes to minus 20 degrees.Since two years i left my family in the winter season.

I want to file mental harassment case against management including above points. I have lots of points to launch case which are time consuming for you to read.

Actually my question is where could I launch mental harassment case? Whether it is in CAT or Human rights comission or local police station.

respected querist,

problem regarding the service break down and stop of payment be filed into CAT and rest their is concern of iregularity regarding your transfer as you have completed your tenure in the interior ,you can file case in civil court or can approach human right commission regarding this ,your above mentioned detail have sufficient ground to sue your officials for mentally harshment of yours but we have to discuss some legal points as a single loop hole or technical mistake can lose your case,feel free to call on 9459321520 and mail id is advocate_anish@imap.cc

Shouting, coercion, threat, rudeness, foul language at workplace is a bad conduct.

It reduces a superior to an inferior.

Employee should record such transactions{audio/visual} and keep evidence  e.g. fellow colleague, union.

Your union is supportive. Gather enough evidence.Highlight illegal memos.
