Need guidance in jj act

Wife filed a police complaint stating that the husband and inlaws are harassing her and 3 years old child, and said will return if the husband takes another house and leaves his parents. The husband has taken another house and intimated orally and also sent lawyer notice, but the wife did'nt come back to matrimonial house and gave reply notice that if the husband gives life security in court she will return. The husand filed RCR and as a retaliation wife filed DVC, 498A, and Child Maintenance under JJ Act against husband. Wife is now staying in her fathers house. My question is "can wife claim maintenance for child under JJ act from husband stating that the father neglected the child, since the child is not a neglected juveline and is taken care by mother. Because the act says it apples to children neglected by parents". Can anyone please quote any judgements which states this?
