Serve the warrant on opposite party in the evening after court is closed. so that he could not get the bail.

IT DEPENDS ON THE SERIOUS NATURE OF THEOFFENCE/ CASE/ATTITUDE OF ACCUSED, IF IT IS A SUMMON CASE LIKE 138 NI ACT NO ARREST WILL BE TOOK PLACE, ONLY THEY PRESENT BEFORE TRAIL JFMC AND RECALLS U/S 70(2) WITH/WITHOUT SURITIES. OTHER WISE IF IT IS A WARRANT CASE/OFFENCE FALLS UNDER THE BEYOND THE AMMENDED 41 CR.P.C THE ARREST IS MUST.

THE ROLL OF POLICE IS VERY CRUCIAL IN BRINGING THE ACCUSED TO REMAND/COURT.

Sarvesh Kumar Sharma Advocate (Advocacy)     10 May 2011

issue the same(NBW) from the court and then go to police station contect to the police for the arresting of accused!
