Ownership

Dear Sir,

We have an ancestor land at GOA. Land was belong to my grandfather, who died long back. My grandfather is haivng four son including my father. As one of my uncle is staying there, only his name is there on 7/12.  

Please let me know

1. can we add other three brothers name on the 7/12 document now.

2. Does he becomes the absolute owner of the land as only his name is menioned in 7/12, though this land is an ancestors land and not purchased by him.

3. Unfortunately if he dies tomorrow, then does ownership will directly go to his son or it will distribute amongs all.

4. As he is staying there he is taking care of every thing and also do some work on land then does the "Kul Kaida" applicable here in between families.

dear shailesh,

1.yes you can file suit for your share if that property is ancessotral property and not acquired by your father individually in his life span,if your father has acquired that propery himself then he must had made a will on your uncle name.

2.as 1st point answers this question.

3.yes after his death the property will inherit to his children automatically.

Thanks for your reply.

This property is belongs to my late grandfather. My grandfather is having 4 sons. One son is staying where the property is located. For the sake of convenience his name was mentioned in 7/12. However the other brothers ( my father and other two uncle) name is not there in 7/12.

1. My question was does my uncle becomes the absolute owner only because his name is there in 7/12, even though it is a ancestral property.

2. Do we ( my father and other two brothers or their childrens) have any rights over the property after my uncles death or his childrens will become a absolute owner in this case?
