Passport renewal if 306 is going on

For renewal of passport there is a coulmn where you have mention in Yes for question:

"Have you ever been charged with criminal proceedings or any arrest warrant/ summon pending
before a court of India?"

You cannot avoid this as S306 IPC is serious offence. 

NOC from which authority?

Session Court where your criminal case is going on is no authorty under the Cr.P.C to issue any NOC for issuing or renewing passport to accused.

It means, i never get passport?
