Pre-grant opposition

A company based in Hyderabad having its jurisdiction in IPO, Chennai spots a patent application filed with IPO, Mumbai and is keen to file an opposition u/s 25.

It finds a Patent Agent in Delhi having no branch offices in Mumbai or Chennai.  Can he file the opposition with IPO, Delhi. If yes, which IPO would actually be dealing with the opposition case, Delhi, Mumbai or Chennai wherw hearing would be organised.

Yes the firm based in Delhi can file an opposition in any all four patents offices. The registration of Patent practitioner is valid across Indian, which mean any registered patent practitioner can file opposition in any of the four office.

With respect the patent application and the office in which it is filed.

The patent application can be opposed in the same office in which it is applied for getting grant. In your case opposition has to be filed with Mumbai Patent Office. if you require any further assistance you can reach us @
