Property card

My co-operative housing society (CHS) got deemed conveyance from competent authority in Mumbai Suburban district after due procedure. We got it registered too. When the society applied with copy of registered conveyance deed to the City Survey Office to get society's name on the Property Card,the officer refused to do so sighting reason that society has not mentioned the last name endorsed on the Property Card as vendor of conveyance. At that very time Society realised that when it got certified true copy of the Property Card for the purpose of deemed conveyance procedure,the copy had only front page xerox showing the last name as owner of the property different from the one mentioned on the back side. That is, the photocopy given by the person at the desk was of front side only, leading our lawyer to believe that last name on the front page was that of the last owner who is deceased long ago. Actually the back side had some other entity's name as last owner.Notices sent to the deceased owner and his heirs by the competent authority had come back without acceptance and subsequently the authority issued order for conveyance in society's favour.

Now the City Survey Officer says that society must first get the error rectified.

We feel that for the no fault either of the society or of our lawyer, our redevelopment process has stalled.

What do we do now?

In this situation, it is important for the cooperative housing society to take appropriate steps to rectify the error in the property card.

The first step would be to approach the competent authority that issued the deemed conveyance order and explain the situation to them. They may be able to assist in rectifying the error or providing guidance on the next steps to be taken.

If the competent authority is unable to assist, the cooperative housing society may need to approach the City Survey Office and submit an application for rectification of the property card. This application should include all relevant documents, such as the deemed conveyance order and the certified true copy of the property card.

The society should also consider engaging the services of a lawyer who specializes in property law to assist them in the process.

It is important to note that the process of rectifying errors in property cards can be time-consuming and may involve multiple rounds of documentation and approvals. The society should be prepared to follow up with the authorities and provide any additional information or documents as required.

In the meantime, the society may need to put their redevelopment plans on hold until the error in the property card is rectified.

Thanks for your interest in my case and reply. Your solution is exactly what we heard from other sources. But thankfully the competent authority has agreed to prepare Rectification Instrument and will extend all help to get it registered. But here also the City Survey Officer is not ready to preview the instrument so that we can be sure to get our name on the Property Card whenever we present it to him for mutation after rectification and registration.
