Purchase of land with proper rtc but no bifurcated patta

10gunta land was partioned to my father family members (not ancestors property but was purchased by my father and uncles) each getting 2 guntas and each have their updated RTC and patta updated. But 2gunta was given to 1 family with 2 brother's in 1 single deed (joint ownership for 2 guntas). Both the brothers name is reflected in the RTC but only the 1st brother name in patta book. Now I want to purchase 1 gunta land from the 2nd brother as he needs money and want to sell his portion of land. How can I purchase this land so the 1st brother would not create issue in future. Also since patta is not bifurcated will this create issue. Can we purchase the property without the 1st brother signature as i am not purchasing his portion of property. Please help as I don't want to loose this land as the land was purchased by only 2 people, by my father and uncle but being partioned to other 3 family because of other family commitments, who paid zero but expecting many lakhs to sell.

Ask him to get noc or consent to execute the necessary documents to sell the property in your favour or else tell him to file a application for sub division of the land, pursuant to the subdivisions of the revenue documents then you can buy from single person.

Sir, Does the NOC need to be registered or can it be taken on a estamp with notary
