Regarding AGM and audit coperative housing society.

Ours is a Housing Society reg. under Maharashtra Cooperative Society Act 1960. The newly elected committee members have not called for AGM and have not done financial audit since the election of the new committee (more than 2 years). The reason given to registrar on complaint is that the new committee members are not handed over charge / books by previous committee and previous audits in old committee period is still pending. The new committee in spite of this fact has opened a new bank account and collecting charges from the members for more than two years. Also the committee is not calling for AGM since election. Can the registrar cancel the committee u/s 75?

The jurisdiction vests with the Registrar. Send representation to the Registrar to intervene.

1.  Make proper Application with 100/- court fee u/s 75(5) for disqualification and dismissal of committee.

2.  The new Committee CANNOT make the excuses that you mentioned.  It is legally not tenable or excusable under the law.
