Regarding full and final settlement

 

Hello All

I was working with a Software company as Head Sales, 30-11-2016 was my last day at work.

My Director asked me to put down the papers he just gave me 20 days’ time for job search. Reason he gave me is Performance Issue. During the 20 time he didn’t give me chance to go and give any other companies.

My 2 Months’ salary is pending and now he is not issuing my salary of Rs. 60000/-.

I have already cleared my all dues and received all the documents like no dues certificate Reliving Letter & Experience Letter.

Please suggest what I can do?

It is good that you have recieved NDC, Relieving letter?

What is stated in relieving letter on your conduct and perfromance?

Have you written to employer under proper acknowledgment?

According to you why employer is not paying due wages?

Do you have any evidence that you were asked/forced to resign?

Did you resign with immediate effect or tendered notice of resignation?

Do you have copy of resignation and its proof of dispatch, delivery, acknowledgment, and acceptance?

Do you have salary slips of all months, Form16?

Has the employer issued any FnF statement showing all payables by it and by you and net amount if any payable by either by employer or employee?

What was exact nature of duties on record with employer?

Did you have any power ( not just recommendation) to sanction leave/increment/appoint/terminate?

You were located in which state?

How many persons are employed in it?
