Regarding joint patta

Hi,

We have 1.86 acre of land near Hosur, Tamil nadu and out of which the land is in Joint patta with other party. 

Out of which 1 acre of land is in our possession and remaining 0.86 acres is in other party possession.

We tried to request for seperation of patta but other party is not ready and creating other kind of issues.

Can we approach court for getting patta seperated and get patta for 1 acre of land which is under our possession?

We have possession certificate from local VAO for 1 acre of land which is under possession.

Note: Either us nor other party has any mother deed/any document related to land we only have patta.

Since the land is used as agriculture file a suit for partition before area Tehsildar / Talukdar / SDM through a local prudent lawyer.

If your portion of property has been demarcated upon the certificate rendered by VAO, you may better submit an application for issuing a separate patta to your portion of property before the Tehsildar/Land revenue officer.

He will send notice to both the parties and on receiving any objection, he will conduct an inquiry and pass orders suitably after solving the objections or pending issues between both the parties.

Don't rush to court for a solution before exhausting the remedy before the Tehsildar/land revenue department  in this regard.
