Related to civil issue

I constructed my house on 2016 in a plain layout. where i somehow constructed the drain in my own money and there were no drainages laid down by the village panchayath TILL DATE. In 2018 another house was constructed right side to my house. Even though i instructed so many times to construct drain to the level of my house drain, he constructed a bit higher. Now all wastes which were streamed to flow in front of his house as per the layout plan which i studied. Now due to the heightening of his drain all waste strucks in front of our house. i even instructed this to them around 2/3 years ago. now they had rented that particukar house. now my question is:

1)whether is their any standard measurement of drainage ?

 2)what if panchayath decides to heighten the drainage to their level ? then the whole pipesystem of my house needs to be removed .

3)on the other hand, can i bring action against my neighbour to just decrease the height of drainage? 

4)what suit shall i file if yes?

You can initiate action against your neighbour. Instead of rushing to the Court, you have the option to serve a Legal Notice and/or approach the Adalat functioning in the local Court under the Legal Services Authority.

Afte ascertaining the facts and obtaining a report from the structural engineer, you may issue a legal notice to the neighbor about this and instruct him to streamline his drainage as per the layout rules failing which you can warn him that you will drag him to court for suitable remedy and compensation including the litigation expenses.

Both constructed drain as per the plan sir. But we r the first to build our house and they constructed house later. they constructed their drain higher than ours .

Get the matter sorted out amicably engaging respectable persons of your locality, which is the best option in comaparision to opting for a legal course of action, which is time consuming, uneconomical, full of tensions besides the evitable enimity among neighbour(s) and its consequence.
