Section 306 i.p.c.

A lady committed suicide leaving suicide note in a piece of paper stating the name of the accused person. The hand writing of the suicide note was compared with the another hand writing in the exercise book of the lady and the hand writing expert opined that both the writing are same. On basis of the hand writing expert opinion will the accused be convicted? if it is no then please refer some judgement.

There could be no conviction solely based on the suicide note, even if proved to be in the writing of the deceased person. The prosecution need to adduce corroborating the allegation in the suicide note .

Ther opinion of a handwriting expert is not a material evidence to decide about the offence of the accused or it can render him guilty of the charges filed against him.

It is just an opinion, it means it is probable and not confirmed.

The other factors/evidences  leading to the crime/offence would be the factors to be considered to covnvict the accused.

The major requirement for a suicide note to be considered as a dying declaration is that a suicide note must be connected to the cause or any such circumstances of the transaction which was the reason for the death.
