Step father in passport

Hi Sir/Madam,

Please bear with me i have much to explain about my case.

My mother has married to x-husband, then she had a daughter and x-husband died. Then my mother married a y-husband, then she had 2nd daughter and a son(Its me).  Then there were some issues with y-husband, then they have been started living separately.  I(Son) am living with my mother and my younger sister living with y-father. The mistake my mother did was, she started using x-husband's name in my educational proofs. All my educational certificates must have been used x-husband name, and my younger sister has y-father details in all her proofs. i knew its a fault.  What i am asking is, my passport contains x-father name and my younger sister personal details has y-father's name. If suppose she applies for passport if she puts y-father name, when she want to come for abroad as a visitor to visit me, then will be there any problems???

1.
In my opinion first the Passport Authorities in India should not have issued a Passport to you with X-father (deceased now) name as your natural father. Passport Authorities ask for original copy of Birth Certificate to verify once DOB.

2. Second, Registrar of Birth and Deaths cannot issue your Birth Certificate with X-father as your natural father unless your mother at the time of your birth sates / gives X-father as your natural father name at Hospital / Nursing Home / even if home delivery (later reported your Birth for Registration) as info at the time of filing the birth announcement as per Rules Form and.

3. Now having pointed out the grave mistakes from your birth cirtificate continued on to your school leaving certificates to your Passport the second part of your question could be answered clearly as there is not going to be any problem to you and to your biological sibling sister as she is coming to visit you on a "visitor visa". She can jolly well use your mother's i.e. her Y-husband as her father's name starting from her Brth Certificate to yet to apply Passport as per Law.

However you are cheating Public Authorities (India) is my straight forward view and it is Lord Hanuman's leap to change all these in Public Documents.

Above reply is made based on your above facts before us where you clearly say you are son of Y-husband and when you say so then ir-respective what your mother’s relations with Mr. Y as husband were, a natural father always remains a natural father for a son (children) unless s/he (children) is adopted as per Law by some now an X or Z – natural father which is not the case in hand !

NOTE: When you use YOUNGER sister as "relationship word" here then I took it that Y - husband of your mother has fathered a daughter and you. It is obvious one of it is younger to you ! Also daughter from her X-husband cannot be younger to you which is also obvious as Y husband came to your mother's life later !!!!

Thank you so much for your reply.

I am not cheating India neither public in India. According to the statment given by my mother, in my school started using x-husband's name as my father's name.  So that is fine if i have x-husband's name in records, it was my mother's call, and i was a kid at age 5 when we joined to school. right!!!.

So now the advise i need from you is, (assume my sister will get passport with y-husband's name as father name, from her prospective it is very clear, she will get it) if my sister goes for visa stamping with y-husband's name, will they cross question like why your brother(me) having father name as x and why you are having father name as y ???

Pleasse give me your advise.

It is again reiterated;

- First sister from X - father makes her elder to you.

- Later a second sister and you from Y - Father as you say yourself then this second sibling sister who is younger to you makes you oldest child from Y - father and not from X - Father .

Above besides your own clarification which I understood before you even clarified them here, that is why earlier reply revolves lengthy answer with a observation and the advice is again clear, “NO” so far as visitor visa interview followed by stamping are concerned.

Children do get adopted from time to time and which sister is visiting you from which father I am not even interested to know now. Hence it is obvious fathers name may change in Birth Certificates as in invitation giver and visitors birth certificate in reference to context which is what to be said before the Officer conducting visa interview of her as being put for possible visitor visa and thus gets asked here and lastly I doubt your Bith Certificate gets annexed in Visa Invitation and which Consulate - Embassy - High Commission we talking here !!!

However I will stick to what I observed earlier in this second and last reply on this thread form my end, that it is cheating the Public Authorities by stating X - Father name as your natural father when you were born by Y- Father and X - Father died before Y - Father even came in your mother's life. I am not interested to know all these  semantics as it is not proper to ask all these personal happenings in once life now other than clarifying once again on my earlier reply here with same wordings which is again a clear 'NO' for Visitor Visa.
