Tender black listing

One govt contractor is  blacklisted in Rajsthan govt works  for 3 years and tenure of ban still not completed. 

His competitor in Gujarat has collected the documents and represented to Gujarat govt to ban business  in Gujarat and not to  qualifies in upcoming tenders. 

Also Rajsthan govt department official has written request to Gujarat govt department to recover outstanding dues of said contractors with all above documents. 

The said contractor is not banned in the Gujarat. 

What stands  should take in Gujarat?

Please guide in tender matter.

Prequalification/Post Qualification shall be based entirely upon the capability and resources of prospective bidders to perform the particular contract satisfactorily, taking into account their (i) experience and past performance on similar contracts for last 2 years (ii) capabilities with respect to personnel. so clear the dues to Rajastan state and clear their doubts in the tenders.

As the Rajasthan government has notified the Gujarat government about the black listing of the concerned firm, now it is the government of Gujarat to take appropriate decision as per their discretion.

If the Gujarat government is illegally blacklisting the firm without any base or valid reason then the firm can file a writ petition before high court of Gujarat to get his grievances redressed.
