Tractor insured but not trailer

Under s. 146 of M.V. Act, when tractor is insured , insurance of trailer is not necessary. There fore insurance company can not deny it's liability on the ground that trailer was not insured.

But in this case, tractor was insured for agricultural activity and met accident  while transporting iron rods and bricks,  therefore it was held that insurance co. is not liable on the ground  of violation of conditions of policy and not on the ground of non insurance of trailer. 2010 (4) AWC 4087 FAFO No. 600 of 2009, Liyakat Ali v. Smt Chunni Devi , Decided on 16/07/2010
