Transfer property

Dear Sir. 

My grand father has died without making any will or distribution of property. Now we want to registration the land in her wife name.

can we pay stamp duty and registration for registration of land.

is there any other thing we need follow.

your grandfather had died intestate which means that it will devolve on the class one heirs (mother, wife and children) if none of the class one heirs are there it will devolve on class two heirs.since his wife and children are there the property will devolve equally to all of them.if you want to register the property on his wife name then his sons and daughters must relinguish their rights over the share in the property through a relinguishment deed
