A trademark owner who believes its mark is being infringed may file a civil action (i.e., lawsuit) in  court  for trademark infringement, depending on the circumstances

Violation of trademark is punishable with imprisonment for a term of not less than six months and up to three years. A fine of fifty thousand to a maximum amount of two lakh rupees.

It would not be a problem till the time some party opposes your use or someone uses a mark similar to yours.

Registering a trademark is not a legal mandate, its more about protecting your intellectual property.

If you register your mark then no other party shall be able to use it and if they do then you can take legal action against them.
