To file a case in this section is it mandatory that it should be made a company party or the person who signed the cheque.

Under 138 the person who signed the cheque is the party. If he represents the company still he is the party.

generally both are parties. Company and signatory should made as parties.

I agree with Sanjay Sir. You have to show the company also as a party if the person signed as authorised signatory or the person representing the company.

JUST TO ADD:
THE PERSONS RESPONSIBLE FOR THE ISSUANCE OF THE CHEQUE SHOULD ALSO BE ADDED AS A PRTY BESIDES THE SIGNATORY AND THE COMPANY.
