Dear All,
I have a very interesting case to discuss. I live in a housing society with belongs to charitable trust and only a specific community is allowed to own a flat in this society as per its constitution and bye laws. Now I have very interesting case. One person who is staying currently in our society is ex-corporator (won 3 times) . In in his 2nd BMC election he declared himself as OBC and contested election and won. He has shown his fathers caste as OBC and got a certificate for himself.
The flat is in his father's name. My question is how can while occupying this flat he can show non-obc caste and contenting election he can show OBC caste? He is enjoying benefits from both the castes. Is there any law to prevent this?

But you have not given details that originally to which class he belongs whether OBC or non OBC.
If he is non OBC, yes, this is very serious issue. You can file a case before the district collector stating the above facts. He will be immediately debarred from his position of Corporator.
If he is OBC, the flat which was alloted to him will be cancelled.
In either way, whether he may be OBC or non OBC, he has committed a crime by showing different clasess in different incidents and he will be punished under IPC.

"only a specific community is allowed to own a flat in this society as per its constitution and bye laws. "???? IS also a great question to understand!!??
Why didn't you complain about it?
What opinion is needed for it?

What Mr. Shroff said is true, but every body will be fear of giving complaint against the politicians, since they have influence of harassing the complainant in one way or the other.
The complainant who can withstand to the influence of politicians, definitely can punish them and put them behind the bars or at the least remove them from their post.

Repeated question, I have already told to give application before MRO, copy to RDO and District Collector. There is no need to be afraid. If you are not willing, get it done by any other person. As it is public interest problem, anybody can give the complaint. If he is found guilty, the revenue personnel will refer the matter to Police station from their end.
