About will registration of pagdi system property....

(Querist) 20 July 2015 This query is : Resolved
Respected Lawyers and Readers,

My Grandmother has a Pagdi System shop and Pagdi System house which is located like back to back in Mumbai. As She is staying in house and I myself her Grand Child handle a her shop.

I am staying with her and taking care of her for each and everything.

Now, She wanted to make a WILL, where she wishes to give that pagdi system Shop and House to me after her.
Can I make the Registered WILL for Pagdi System property OR WILL should be in Notary Only?

As per my knowledge, Notary WILL can be challenge in the future.

If there is any other option, Please let me know.

Thank You Sooooo Much in Advance.

It is not necessary that a Will be registered. However, it would take care of future complications.

Then actually, Registered WILL is better or Notary WILL is better for Pagdi System Property. Which is the best as no one will challenge in the future?

She is not the absolute owner of the property but a tenant under Pagri system. Consult a local lawyer.

I agree with expert advise of Mr. Rajendra K Goyal, your grandmother is only a tenant in-possession of demised premises and not owner/title holder, she has no right to execute a will in your favour.
