Hi,
I have a house which is in name of my mom and me. Now I am married and I want to add my wife's name in the house property. So what is the procedure to add my wife's name in House property. Can you please suggest me some solution for this.

You can gift some portion or absolute of your property by a registered deed of gift in favour of her.

If you want your wife's name to be added as a co-owner of your property,then gift the property by registering Gift Deed in her favor.Stamp duty for gift deed would have to be paid.

First of all the question would be 'Why at all you need to add your wife's name in property' as even otherwise she would be your legal heir. Such transfers generally aren't cost effective and do invite complications. Still to have proper advice you need to provide full facts i.e. from whose money the property was purchased, since when you are married, purpose of intended inclusion etc. However in plain your mother or you or you both can gift desired part of the property to the one intended to.

Gift through will is one option. I tend to agree with Mr.Pradeep Kumar views as in any case she will be the legal heir for your share. If it is for tax saving on rent etc., better consult CA for a solution within the provisos of IT rules.

Will comes in the operation only after death and as such the same is not a gift.

You can gift your wife some of portion owned by you in the property. You can not force your mother to gift any of her portion to your wife, however she can do so if she agree.
Your wife would be owner of the portion to the extent of which she has been gifted.

In order to bring your wife as one of the joint owners to the property, either you or your mother or both can execute a registered gift deed in her name by transferring a portion of the property with or without any demarcation, after which she will automatically become a joint owner along with other owners of the property.
