Dear Sir,
Sub: Advice for Supreme court Appeal against dismissal of quash application by high court
We are looking to approach the supreme court against the order of AP highcourt dismissing the quash application.
The facts of the case are that we advanced loan against gold articles and when the customer expressed her inability to pay interest or release, she issued authorisation letter, authorising us to dispose the articles. To avoid future conflicts the articles were disposed thru her only and she issued a cheque towards balance in full and final settlement. The cheque was bounced and we issued legal notice and filed the cheque bounce case.
As a counter blast she filed a cheating case, against which we had filed a quash application in the AP Highcourt the same was dismissed as the prosecution misrepresented that the forensic report confirmed signatures in authorisation letter are not matching infact the forensic report has confirmed that the signatures are matching, We filed a review were in the Highcourt has observed that the trial court shall not be influenced by the earlier order.
We have also filed a civil suit against to which she has also filed a counter claim civil suit and they are pending. The Cheque Bounce case filed by us was dismissed on technical ground of limitation (which we are advised is not correct) against which we have filed an appeal and its pending.
Kindly advise us as to the mode and terms of engagement as to,
1. Is it advisable to approach the SC in your opinion
2. what are the chances of admission
3. before whom the matter is likely to be listed
4. Chances of Final allowing of appeal
5. Fee & Expenses structure
6. Who will be appearing before the court, will there be any senior engagement etc
and any other issue which you may fill necessary to be brought to our notice.
