(Querist) 30 September 2010 This query is : Resolved
assume that some is suffering from HIV +ve then can he be treated equally...?
Parthasarathi Loganathan (Expert) 30 September 2010
Article 14 of our Indian Constitution stress the need for Equality before Law. The State cannot deny to any person equality before or the equal protection of laws or discrimination on the grounds of religion, race, caste ,sex or place of birth.

Hence it goes without saying even if the person is suffering from any disease he has to be treated at par. Law is very clear on this aspect Mr.Kale.

Equal treatment in such a case can be subjected to reasonable restrictions by the state. It cannot be an unqualified and absolute one.
Advocate. Arunagiri (Expert) 02 October 2010
Under the circumstances the equality here means the equal opportunity to get treated at par / equally with other patients. The equity is to be given reasonably. You can not give equal opportunity to the Graduates and illiterate in attempting the Civil services exam.

My dear friend how can an illiterate becomes eligible to write Civil Services Exam?
