attachment of ppf &epf

Dear Sirs

If the member dies then the EPF/PPF is not attachable from its nominee sec 10(2) of act.Then why should it be attachable if the member is alive & withdraws the EPF/PPF and is able to prove that this is from that a/c on his retirement after 60 years of age.

Though the discussion over the already framed law framed cannot be helpful for you yet the theme can be discussed.

Accumulations of EPF/PPF are not attachable in the hands of nominee and are recoverable in the hands of subscriber only because the subscriber has directly deposited that amount in his account and decree can validly enforced against that accumulation whereas in the case of nominee, such position do not exist so it is not required to be attached.
