Bank account

(Querist) 29 March 2024 This query is : Resolved
I was having SB account with ICICI Bank.
I have 0 balance in my account
The bank initially refused to close the account initially.

After raising the voice they have closed the SB account.
And now sent a DD for Rs.10.01, when I have zero balance in my account.

Please let me know can I file a case against the bank.
If so, please let me know under which section or Act should I file the case

You have not stated what is the dispute? You have also stated that your a/c is with zero balance.

My account is closed. On the date of closure my bank account balance is zero.
After closing the account bank sent DD for rs.10 without any covering letter.

I am worried and like to file a case against the bank for annoying action of sending rs.10

Instead of straightaway jumping into any legal action, you visit the bank and clarify the reasons for sending you this DD for Rs. 10/-.
If you are not satisfied with the reply then you can plan to proceed legally against them.
The section and provisions of law can be enquired from the lawyer you will be engaging for this purpose.

I presume that they sent this DD for RS.10 only to ashame me since I have raised voice when the account wasn't closed earlier.

It is simple logic to understand, when the balance in account is zero, and that too the account is closed, how is it possible for a bank to honour me with a DD for ₹.10.01
And for such big amount the DD was signed by two authorised signatories.

I am worried now and planning to file a case against ICICI Bank for giving mental agony.

Please advise and suggest

First of all know the rules of the bank.
Even if you are intimated that you are left with no balance amount to maintain the account, since it is a zero balance the amount whatever still left in your account shall be returned to you.
The staff of the bank are not your enemies nor you have any personal vendetta against them, hence you can put a control over your imaginations.
The idea is simple - you can open a Savings Account, but you don't have to maintain a minimum balance in it. As the name of the account implies, this is a zero-balance account. Therefore, you don't have to maintain a minimum balance. Consequently, there is no penalty in the case of zero balance.

Remember that without any balance amount in your account, the bank will not send this amount to you, there fore do not take any hasty decision which may backfire and may land you into more legal troubles. .

Thank you ji..

I do understand it is waste of time.
But not really known how this will backfire?

I narrate the situation below
- Balance in my account is zero as per Bank statement on the date of closure
- There is no interest applicable on zero balance account. The never given interest in my account in any financial year
- The DD was sent for ₹.10.01 looks awkward
- The DD signed by two authorised where for such amount it is not required to sign by two, and sent by local courier
- The DD is without having any covering letter nor any mail communication.
- I could understand ,The action is only to annoy and it is a kind dis mannerism.
- There is no reply from the bank when it was asked.

Even for arguments,
if they say some reason to honour me, they should have communicated with a covering letter .

And I am sure that, I have reason to spike this. I feel
Atleast,
I should bring to the banking ombudsman or in consumer forum to prove that the bank is at deficiency in service

You have all the rights to do whatever you want to do, however instead of following the proper procedure and exhaust the remedies available locally, if you insist on your own ideology, you may proceed accordingly instead of wasting your time asking advise from experts from this reason, just because you are getting advises at free of cost.
