Benami case is in progress in court in India. Wife obtained divorce from court in America. What will be the effect on her as Respondent u/s.4(2) Benami Transactions Act,1988. Will she be allowed to defend the case now.

yes she has to be allowed to defend the case.

.You must have joined her as party deft.,so how she can not defend ?

If she is a party to any suit and even if not impleaded then on making her application under order 1 rule 10 of cpc, she has got every right to defend/protect her civil rights involved in the matter in dispute.
