Redevelopment of society

Our society is going for redevelopment. Our flat has 2 balconies which we internally converted to room. My question is whether balcony area is considered for redevelopment or not. Eg. If builder decided to give us free10% area whether he will give it based on carpet area mentioned in our property papers ( balcony area is not mentioned as carpet area) or he will not consider balcony area for the same. Our balcony area is 100 sq ft.

Cost-caveat in supreme court for suit for title & possession

our matter is presently before karnataka high court. The lower court ordered 75% to us & 25% to our opposite party. Partition has not done. Now the property is vacant & open space (Earlier there was a building). My query is 1) If high court orders complete 100% to us can we immediately occupy the possession. 2) Is there any process (like affidavit, form etc) to update to high court that the land is vacant & open space to all. 3) if immediately cannot what is the process to get the possession ASAP (Before he goes to appeal to Supreme Court? 3) If high court orders again 75% to us & 25% to opposite party what is the process to get the possession? 4) Let me know the cost to file CAVEAT in supreme court for the same case. Tree have been cut down

Dear sir ,

Tree has been cut down in my land by neighbor person . I have video and photos of it .

I do not know to whom to approach and which designated officer to approach sir and which forms to use to fill complaint/application .

Do I need to approach magistrate or forest department or police station sir ? or directly approaching court ? what procedure do I need to follow if police officer do not take any action about this .

Kindly , I request to step by procedure to follow about this . thank you

Gpa

Hi ,
suppose A is the POA ( GPA) given by the previous land owner B.
and B executed a agreement to sell , will , affidavit , payment receipt all in name of C ( A's wife ).

1. so now can C sell the property , A died and C have death certificate of A. ?
2. can C registered the GPA , agreememt to sell etc now since its been some yeara.
3. Can C make her son POA now ?
4. While selling it to some other buyer D now can sub registrar ask us that why these documents are not registered ?
5. Also how we get to know if the gpa , agreement to sell etc is registered.

Took money from my girlfriend unable to give her

Hello, I borrowed money from my girlfriend on interest. She told me that she is taking it from other person and I have to pay interest on that. I have interest for 17 months but from last 10 months I don have money to give her. Im asking time. But she is saying she will come to my house with police and file a complaint against me... She told she will also complaint against my faimly too. I promised her to give money till April but I'm not able to give it. I try to convince her but failed.

She is saying she will file a complaint that I took money from her..and complaint for harrassing her mentally.

I spent lots of money on this girl. Now I'm afraid.its a matter of a girl and she can file anything wrong in complaint...


Positive part is I never met her. We met from youtube and we r talking from last 4 years.

What shud i do in this case to b safe? I want to give her money but it will take 2-3 months. But she is not ready for that.

Girl is from Madhya Pradesh and I'm from Uttarakhand.

Kindly guide. She warned me that she will file complaint against for not giving her money. For harringn her mentally. And for din know wat more. Kindly guide.

I took 5 lac from her and given 3.5 lac as interest.

Appeal

Hello Expert,
My uncle lost one application filed by opposite party and order is passed on this exhibit.
But now uncle is out of city and appeal need to filed on urgent basis.

Can lawyer in Civil Judge Senior Division file Appeal in District court without my uncle signature? If yes, please provide us some rules under which lawyer can file appeal, or party sign is mandatory to file in Appeal.

How to prove legal heir or wedded wife? by divya

My father was central govt employee. He went missing in 1999. My mother lodged FIR in 1999 and after a year, police submitted their non traceable report to the dept. Dept told my mother that she can only apply for family pension after the period of 7 years. She went in 2007-08 but They told my mother that my father is removed from services.

I filed RTI in 2015 to know the reason of his removal. I got to know that they filed charge sheet on the basis of absence on duty. We challenged the removal order in tribunal. Now they replied that there is other name in nomination so the dept is now saying that the nominated person is first wife of my father. So my mother is not entitled for family pension. My mother never heard her name from my father/in laws. My grandmother was died when my father was 5 and my grandfather died 20 years ago. We also not in touch with our father's brother.

I went to our native village to confirm from the people who know my grandfather/father. One of them told me that she was his first wife but she left him because my father was mentally upset. She filed divorce decree after 6 months of marriage. Ex parte decision was in her favour and she granted divorce. After some years, she got married to another person and my father got married to my mother.

We got free legal aid from Dist Legal Service Authority. Now our lawyer is saying that he going to withdraw case because we hide facts from him or else hes saying that look for that first wife and take affidavit from her that she dont have right on family pension, she divorced with my father and remarried to another person. Second he told us that if we produce succession certificate/legal heir certificate then case can be in our favour.

Now the first problem is that we dont know where is she and second problem is that police didnt provide us non traceable report. The dept obtained non traceable report directly from S.S.P so without non traceable report we cannot apply for death certificate and without death certificate we cannot apply for Succession Certificate and Legal Heir Certificate.

Please help what should we do now?

Minor car accident - stepped back from verbal settlement

My car involved in a minor accident with one tempo traveler last week. it was clearly tempo traveler driver's fault and he agreed to pay the bill after the repair of my car. When I called him with the bill after getting my car serviced, he refuses to pay saying the fault is mine. Can I approach the police to register the case after this one-week delay saying the verbal settlement violation? I have car dashcam footage of the accident and the opposite party is not aware of it.

with respect to 1956 Hindu succession act

Hindu succession act 1956 is retrospective or only section 6 is retrospective.

Which law applies before 1956 .

Review application

In response to Mat suit that was decreed ex-parte, the respondent filed an application u/ order 9 rule 13. The application was allowed on erroneous ground that service was not undertaken by court process server. However, during review of the said order, the HC acknowledged that the service of summon was undertaken in ‘more than one way’ but prayer of petitioner to set aside the order u/o 9 R 13 was denied because for different reason as stated by HC ‘there was a change in 'set of Lawyers' during review; which again was inaccurate. My query is whether I could ask for review of the order in lower court where the decree was set aside based on the High Court order?
