Clarrification

I am not sure whether my earlier querry was drew attention or not ,so I am repisting
The issues is regarding a probated will.I am,the respondant .The case came up for hearing during 2019 .The plaintiff did not appear Only his advocate appearedand I appeared once .The information received was announcement of dismissal on 5/1/21.The plaintiff appeared on 5/1/21 and submitted some document as E1to6 which are correspondence between him and testator, inrespect of his claim..The will got partioned between the two and an affidavit was drawn-by an Advocate having taken pocession of indivitual share during 1996 .I am in,full enjoiment of my share till date .The testator has not changed the will and registered probated .Clarrification is sought now whether the court will take or consider the correspondance between the plaintiff or ignore and act as per will which was probated.The will was probated by plaintiff .
The present indication,in court is judgement on,28/1/21.Kindly,clarrify what is the law .will or correspondance Thanking you,

Heavy leakage from upper flat

Sir
I am staying in Mumbai in conveyed housing society
Because upper flat owner shifter their kitchen to bedroom & bedroom to kitchen & made many illegal addition / alteration
Since 5 years there is heavy leakage from upper flat to me bedroom, kitchen, toilet & utility place
Requested many times to upper flat owner but they are arrogant & refused to repair it
In meeting also upper owner threaten me that they will break their floor tiles to make heavy water leakage thus making us difficult to go to toilet
I adjusted many years as I used to repair & gave flat on rent, many months in between my flat went without giving on rent because of leakage
Now I plaster ceiling & got whole flat painted but after completion of painting they purposely made heavy leakage in my flat damaging color, ceiling & walls & now its unbearable & cannot tolerate further
Society committee is has helpful people but upper flat owner will never get it repair not will allow society committee to enter the flat for inspection
I am planning to write letter to upper flat owner, society, Dy.Registrar, BMC & Police station

My query is
1) is there any sequence to write to above authorities
2) what should I perticularly mention / highlight in my letter to police & BMC
3) How much time it would take to resolve this problem, any other ways to solve this immediately
4) what & how much compensation I can demand as could not give flat on rent & harassment, can rent & harrassment compensation be recoverable
5) Who (Government body) can order to restore back their kitchen to original location & other alteration made by them
6) Any other suggestion

Terrace sold / allotted

Greetings,

I live in a cooperative housing society in Pune in which the builder has sold the above half part of the terrace top to the 5th floor flat owner . Before the society was formed.
He has also built 3 rooms toilet with sliding windows doors.. and built a iron stairs from balcony to terrace.
We have also complaint in the PMC and register .
Pmc has sent a letter to society to take action against illegal construction.
But no action is taken by chairman.
As per society bye laws any encroachment by a member in a cooperative housing society is entitled to pay 5 time the maintenance charge from the time it is built on the terrace.

Please Let me know what action can be taken for demolition ?

Removal of old defamatory news in google search

Hello

An FIR was registered against me for theft of cheque later and later the case was disposed on the basis of compromise and I put an application for compounding of offences, that news article still comes up on google search in times of india and another news website and also mentions about my arrest. Can any suit or legal remedy be done for removal of this old news articles since it affects my career and background verification process shows this google search results .I am Currently an employee of a MNC , Can I put suit in any court in India or the state where this was done .

Name issue

In my all documents, my father's name is S B Sharma(Sri Bhagwan Sharma) but in my fathers documents his name is Sri Bhagwan. Now i have to change my address and on electricity bill his name is writtern as Sri Bhagwan so Will it create any problem? If yes then what are posible solutions

Brother took sign from sister in dad's property

My brother took signature in Mamlatdar as i write all property come from my dad will go to his name in future after my dad passed away and now he removed name of 7 / 12 utara but out of 5 sister 2 did not give signature. Can i file objection for this as he forced me to write my rights on his name ?
father añd mother both passed away. We are 6 sisters and 2 brothers. Part of property is self acquired and rest is not.

Notice for the party

Sir,
Our land was acquired for District Collectorate in Tamilnadu. We have filed a Writ Petition in Madras High Court and Madras High Court has favoured us and released the land from acquisition proceedings in 2017. However, some other persons moved Supreme Court and filed SLP in 2019. When we approached District Collector, Karur, he informed that the case against your land alongwith others is pending in Supreme court. But, so far no notice has been served to us. It is requested that kindly clarify whether serving of notice is mandatory and how i come to know that my land also under SLP proceedings. Whether I can ask through RTI in SC.

Kindly help me.

Sop and partition suit

During June 2016, my wife filed sop for her one-fifth share of her deceased father's bank deposits, in sub court. Judge of that period advised us to file partition suit. My wife filed partition suit through advocate. Change of judges within few months of filing suit. (Around 2016 September). Judge in his judgement on December 2020 ruled that only SOP has to be filed and dismissed suit. Even though we paid fees properly to our advocate, during crucial arguments stage, our advocate did not represent us properly not being present. Judge recorded this in his judgement saying both sides did not represent case properly despite several adjournments.We are filing appeal in district court. How can we prepare for appeal? My wife can self argue in court. Point to note is if our advocate was present, judge would have asked him why sop was not filed and we could have given the answer, which may have satisfied Judge.
