Case Disposed-uncontested

Recovery CCA of Jan 1998. Due to serious sickness & non payment of 50% lawyer fees, the lawyer only filed Vakilnama & no reply to contest the case since 1st day. No one appeared for me from 1998. In September,2017 order was passed "Case Disposed-u contested"
Please help. This order has STAY ORDER for Non operation of A/c wherein even my PF & Gratuity checks are deposited by Bank & I don't have ex�ess.

Npa

Can NPA be done after issuing loan recall notice I have taken a loan in September 2009 due to some delay in payment of EMI Bank issued a loan recall notice on 21st February 2011 after that they have initiated arbitration proceedings in which an ex Parte award has been awarded against me meanwhile on 30th April 2011 Bank declared me NPA . In August 2016 Nbfc's were given the power of Surfesi . So they issued a notice under section 13(2) which is under challenge in Civil Court my questions are can they issue notice under section 13(2) as arbitration award is already under challenge and They were given the power of surfesi in 2016 and my agreement was done in 2009 can I challenge notice under section 13 (2)on the ground that they have declared me as npa after issuing loan termination /recall notice

Iligal consructed building

Sir.sadar namste A Person complain to nagar palika & police that the constucted building on govt land. Sir i havv contructed the same building in 2007 after getting diversion certificat alongwith permission from ngrpalika by bank loan and gave on rent to hospital. Every year paid all tax nothing balance up to 31-03-18, related to such building to ngrplika. To open medical shop tenant want NOC from CMO. Due to such complain raised cmo not giving noc as building is illigal construted in govt land. Your & family land has adjoied in govt land. Such land 35 Dismil is PUSHTAINI ihave constructed in 9 dismil.balace area of land is open and land owner is my family . As i am working in 160 km away from home town &complainer alongwith police mentally torcher to my 75 yrs old father what can i do sir. pl. Helpme. Can i apply to demarketion of my land ?

Arbitration

Following are the queries:

1. When an Arbitrator during arbitration imposes cost on a party, who is entitled to such cost - whether Arbitrator himself or the opposite party.

2. In case the party on whom cost is imposed by the Arbitrator does not pay the cost at the direction of the Arbitrator, what are the options available before the Arbitrator.


Please advise.

Appeal period for execution Application

When money suit is decreed under order 12 rule 6. When I can file execution Application as judgement debtors has not prepared for appeal as more than three months has elapsed.

Prolonged suit

Sirs,
My previous lawyer bungled my case and I am in awe of new lawyer.
Contempt application filed by one of the surviving plaintiffs under 39 2a after 7years of cause of action during pendency of the suit and after giving witness statement where in no issue was raised , cause of action now 10 years back and no reply filed by my previous lawyer on contempt application.
I am defendant. Suit is sp. Performance title suit.
After 2.5 yrs hearing taken up by court.
No notice, summons issued on me so far
Two necessary parties on either side no more.
8 hearings have passed. Court neither giving defence evidence, no conclusions.
New good lawyer hired by me but as case is out station and other factors and although case as per my beliefs not tenable case still going on. Plaintiffs an unregistered firm of two and one partner died even before issues were framed. No legal heir named.
Should I write to registrar directly so as to how can suit continue upon death of one of the partners of the firm. Suit instituted by . the firm.

Double registration of sale deed and sale agreement

We buy agricultural land by agreement to sale. And convert the land in non agricultural purpose on the name of the main owner of the land. Than after main owner execute a sale deed for one plot and a agreement to sale of 10 others plot which is duly registeted. After few years the main owner made an application to the collector to convert it for the agricultural use. And mislead the collector that none of the plot is sold. And therefore he need to convert the land in agricultural purpose. collector gave permission and land is converted again in agriculture. And after getting the said permission. The main owner again sale the same land by registered sale deed to third party.

Sale deed to the third party was executed in 2008

We came to know about it in 2017. So i made a police complaint in 2017

And now i am going to file a suit to cancel the sale deeds

And prays to declare the ownership of the property.

Is there any addition needed in the prayer?

Is there any chances to succeed?

Is there any bar of limitation? As the first fraudulent sale deed by main owner to third party was executed in 2008?

HIGH COURT ON A PETITION AGAINST EVICTION NOTICE BY MHADA, OF A FLAT OCCUPIED BY NON MEMBER IN A CO OPERATIVE SOCIETY WAS GRANTED RENT.. RE DEVELOPER ON COMPLETION OF REDEVELOPMENT INSISTS FOR DECLARATION CUM INDEMNITY TO BE PROVIDED AS A PRECONDITION FOR INDEMNIFYING ANY EXPENSES INCLUDING LEGAL EXPENSES FOR PAST, PRESENT AND FUTURE EXPENSES IF ANY BEFORE HANDING OVER THE POSSESSION. NO DETAILS OF EXPENSES ARE PROVIDED. HAS STOPPED RENT ALSO FOR LAST TWO MONTHS. WHAT IS THE POSITION UNDER LAW TO THE OCCUPANT OF THAT SOCIETY

Motor accidents

If deceased is widower and his sons and daughters ( total no. 5 ) are earning on their own except one daughter who is widow and depending on his father. Kindly advise how much should be deducted for living expenses (1/2, 1/3, 1/4 ). If they ( sons and daughters ) file petition, whether they are considered as dependents or legal heirs. Pl clarify.

Rental agt

I am residing in a rental house in Trichy. My house owner is refusing to sign Rental Agt. & even refusing to give receipt for the advance recd. Several times I have reminded her through phone, SMS and WhatsApp. What is the solution? If I stress for Rental Agt. whether she can force me to vacate the house. Experts may kindly clarify.
