Sir,
I would like to ask that a case is pending before the civil court now plantiff have brought new case on the basis that defendant did somethig wrong with regard to present case. can plantiff bring such civil suit with out serving notice u/s 80 to dependant?
Second question: plantiff filed civil suit before a district court without giving vakalatnama but has attached one memo while 3 /4 hearing have already passed.
third question: Is it possible in our judiciay system when civil judge refuses to accept a civil application then advocate may directly approach to District Judge orally and District judge may aks civil judge to accept the application.

1 . My daughter has taken a forceful possession last year aug 2008 in my property and had filled a suit for permanent injunction
2. In May 2009 I came to know that after getting injunction from Distt Court my daughter is willing to sell out / hand over my flat which is under my daughter possession after that I had also filled a suit for injunction in District Court (Patiala House) not sale / transfer the said flat.
3. My father had made a Will ( Registered at Vikas Sadan ,New Delhi ) in favor of me and my wife’s name before his death and also excluded my daughter in his property .Later we got mutation from MCD.
4, I am going to file a Suit for Possession .What Else we can do .How Long will it took .Does my daughter had any title under Hindu Marriage Succession act in my property.
5. Is there any act in the favour senior citizen that suit can be decided early comparitively to the normal times

Plaintiff suit for eviction from her house on ground that she needs accommodation for her sons who are going to get married. Plaintiff has not stepped into the witness box though witnesses including her power of attorney have been examined on her behalf. Is plaintiff entitled to a decree? Plaintiff has not stepped into the witness box to express her need. Request Opinion with case law. Thanks.

Mr.Shabbir Ahmed is having a daughter who is residing with her maternal uncle since childhood in Mumbai.Her name in her matriculation certificate is mentioned as Miss Sana Shabbir Khan and her father's name as Mr. Shabbir Khan. Dear Friends,
In a partnership firm having 3partners and the partnership firm having 3 flats if all the partners want to take the flats what document has to be made?
I have registerd my sale deed but am unable to find the orignal or to procure the certified copy. Now when I want to sell the property the bank of the purchaser is asking for the documents in this case what should I do?
If a sale deed is executed and stamp duty is paid and I again sell the property then will I get refund of the stamp duty?

again posted with facts on 03-09-2009.
the respondent is my friend. a civil suit has been filed by the senior officer against the junior officer of the same department(Central govt. employee) in the local district court. Can such type of cases are matter of district civil court? or being service matter is subject matter of central administrative tribunal or while senior was in supervisory capactiy should not act like this.As repondent represented his office several times but recd. no reply. Defamation suit of rs.20000 has been filed by the senior in the name that junior abused him. what type of remedy is available in this case.

Again added on 03-09-2009 : Fact about the case is that after transfer of senior to another place and got stay from the high court cases has been filed against the junior in the district court while such thing not happened at all, moreover In his petition against transfer order before the high court at later stage Sr. included Junior falsely as a respondent in his transfer application in the name junior was creating hindrance in his official work while high court rejected his application. senior officer is doing all becoz of ego issue and to harass junior mentally and morally as office is not taking any action.

we had filed a RP in NCDRC and the judges have told to file a petition to add respondent parties again to the case.
can anyone please send the format of filing petition to add party as respondent to the NCDRC.
The matter is most urgent as the next date of hearing is in Ist week of october 2008
