D V

I have lodged the complain against husband and parents of the husband under the section 12 of D V Act now parents already presented themselves in the court but question is that the husband is at the dubai working some where and parents knows the address of his son but do not want to disclose the address of this son regarding the said connection i gave application before the court for the disclosing the address of the son from the his parents the said application was rejected by the court now i would like to get the whereabouts the said son means the husband of the applicant so what i should do to get the address of the husband can embassy will provdie something pls suggest

Divorce procedures

Sir,
It has been around 15months since i got married and i was staying with my in laws. Though there were many arguments, fights between me and my husband we loved each other. but recently 2 months back during an argument my husband beat me badly and because of which i had to come to my father's place for 10 days. My husband though a professional is dependant much on his mother and on her advice now he is not willing to stay with me and asked for 3 months time before he can decide upon anything as his mother was not well and we are living separately now.Meanwhile he has sent a letter in registered post with acknowledgement wherein he has accused and blamed me of abusing his parents, not doing household chores, doubting his character, frequently leaving to my father's place and has concluded that because of all these he is under mental agony and not able to concentrate on his career and wanted time to recoup. Please tell me if this is any step to legal proceeding if so how should i react? I am not interested in divorce, i feel being cheated.

amicable settlement

Sir,
My son-in-law filed an OP in family court through his GPA but the court had aked for his physical presence for reconciliation but he has not attended.The court has decided to dismiss the case.Hence, the GPA has moved the Hon'Ble High Court,but the Court on the day of submission only has rejected the plea and dismissed it.
Now they want to come for an amicable settlement in presence of family elders.However, my daughter is not interested in the marriage anymore.I want to claim alimony for life of my daughter.How should I proceed? Kindly advise.

I had filed for Custody and as interim relief got Court orders of Visist Rights for my Kid in the district court Premises . After 2 visitations , my ex takes the kid out of station intimating she has taken a better job there. Intimation done through courier . Please do let me know the remedy. Regards

A few years back I was blackmailed into marrying a girl with whom I had a casual affair in a secret ceremony ,thereafter i did not cohabit with her even a single day and left for another place on some pretex after a few years I legally married in presence of family and have children,now the girl comes back and claims to be my wife and threatening to put a case against me,how can i prove that my first marriage is not valid...

How to get maintenance to minor male child of American nati

One of my friend's daughter facing family problem with her husband and his family members the details are narrated below.Kindly advice us how to proceed legally.

Details of the case

Both Wife and husband are Indian citizens - marriage held in Andhra Pradesh on 17-02-05, while the husband was working as a software engineer in USA on H1 B visa and Wife a qualified professional BDS Doctor went to USA on dependent Visa - lived in USA out of wedlock for about three years- son born in USA on 03-08-07- both returned back to India in January 2008 to attend the marriage of husbands brother - wife a dentist- written TOEFL , GRE etc., while they were in USA – Wife got admission for MS in US- wife was sent by her husband to US for studies in MS on student Visa in Sept 2008. He assured his wife that he will be back to US after settled some issues with his father and his other family members - she went to US along with son for studies in Aug 2008 - husband has not joined his wife at US as assured instead - He filed Divorce petition (A.P – India) in the court u/s 13(i) (1-b) in Sept 2008 – Got exparte orders without service of summons on his wife in March 2009 – Wife visited India in Aug 2009 – When she went to her husbands house she was abused kicked out by her husband and his family members saying that they got the Divorce orders – Wife filed set aside petition in the same court – The petition is subjudice for trial in the court – Wife went to US for completion of her MS course of studies – Son with the maternal grand parents at ( A.P - India) – Now she intend to file a petition in the court of USA for maintenance of her son (minor male child) who is a citizen of USA in the status of mother as natural Guardian – If the decretal order if any of the US court favours the plaintiff or the petitioner the wife, can it be executable in India?

In addition to the above please advice us to the following doubts?

If the US court send the summons through due process and if the summons were served on the Husband in India, If he fails to attend the court at US the court may pass ex-parte orders.

Whether the ex-parte orders can be executable in India?

For the ex-parte orders passed by the US Court, in which court can he file set aside petition or appeal whether in India or US

Please furnish the Apex court order No and date of judgement.

Mutual Divorce

After obtained Mutual Divorce Decree from the court a Hindu woman may seek again maintenance from her husband or not. If not mention about her future maintenance in the mutual Divorce petition in terms and conditions before the court at the time of mutual settlement. if yes which section apply, please tell, my quarry is it applicable u/s 125 of Cr.P.c or section 18 of Hindu Adoption and maintenance act please reply.

after got mutual divorce she did not marry to any one then is she eligible to get maintenance from her husband.
