Last week i had put a query regarding physical and mental torture done by my husband .
wherein Uma madam had given me good suggestion for compromise .I am thankful to her .
our case is with Human rights organization where the concerned person is helping us out .
He had given me suggestion that now we will see that he will not in future will give you physical as well as mental torture .And about the flat you will have to stay with him in a rented flat only ,you cannot demand him for a own flat .
so i am ready for this compromise and also they gave me option to rent a flat at my place of choice .
so now since i stay at my parents place i have selected same area .And also since my baby is small and my parents will be staying near my place can look after my baby in immergency conditions .
Here my husband agreed to stay together with me at the place selected .
But very next he told that he will be drafting the letter in behalf of my husband to my organization HR and BOSS for the transfer of Job from HO to factory ,wherein he will be convenient .
i am already travelling 2 hrs for my office ,and since now he will also have to travel ,so he creating a mess and giving me warning of taking some steps wherein i will be in problem .
pls suggest how to compromise with such person who only thinks of himself and not of wife or the child .
Dear All,
Please clarify, Any Mohameddan Law expert..
Grandmother was survived by only 2 daughters and the only son had predeceased her with 3 children one male and 2 females.
Whether Orphaned grandchildren are entitle for any share in their grandmother’s property?
As Per Mohameddan law, Orphaned grandchildren are not entitle for any share in their grandparents property as they cannot step into the shoes of their father and succeed in the inheritance as there father would have been if he was alive , According to Doctrine of representation of Mohameddan law, Only heirs alive at the time of the death of the parents will succeed in the inheritance those who predeceased, their heirs are excluded from Inheritance.
But ,There is some confusion when referred to Mullah's book,
In section 65 he says daughter as a sharer is entitle for only 1/3 rd share, As in our case only 2 daughters survived they will get--- 1/3 rd Share --1st daughter + 1/3 rd Share 2nd daughter and the remaining 1/3rd will be residue which will go to the Orphaned grandchildren thru the predeceased son, Is it right ?
Or Orphaned grandchildren are completely excluded from inheritance based on Doctrine of representation ?
Under which Indian Act the marriage between a hindu girl and muslim boy (both are major and native of Tamil nadu) should be registered? Whether there will be an issue to get community certificate and other certificates for their children? If yes, what could be the solution?
Hello all respectable people. This is jayesh here from ahmedabad, india. I have been suffering from my wife's tortures since more than 1 year. I request you to guide me the genuine solution as I feel I m lost and can’t decide what to do further. I have been married since 1 year and suffering from my wife’s tortures. And it is still going on. She has so much anger in herself that she is even not able to control herself, her words, and behaves like an enemy to us. ( Me, My Father and my Mother). She tortures us by behaving very rudely and uses bad language in home. She shouts very loudly and creates a mess in our home. She is aware of the legal benefits which a lady can acquire from our Indian Law. Now the situation is, she has met the lawyer, demands heavy amount of money and blackmails us by saying that she will not go from here and demand huge amount of money. If we not pay her, then she will do case to us 498A and all others step by step which can affect us. In this one year, she has went for 5 times to her home (her father’s) by creating mess in our home. Now she has again came back and tells us everyone that we are asking for dowry to her. When we asked her why she is saying this, she says “now u have to hear all such type of things.” She also tells us that if anything done in the home which is not in favor of her, then she will gather people and create mess. Every now and then, she tells us (Dhamki) for this cases and makes us feel down. As a result we are badly suffering and are not able to focus in our routine life.
As far as I know about the Law, I have came to know from lawyers that most of today’s rules are favoring woman. And If we even file a case against her behavior, or for divorce, it is she who will have all the benefits of law and not us.
I AM SUFFERING FROM A GENUINE TORTURE. I DON’T KNOW WHAT TO DO FURTHER. BECAUSE OF FEAR, NEITHER I CAN GO TO COMPLAIN AGAINST HER NOR ME AND MY FAMILY CAN BEAR HER TORTURE.
I request you to provide me solution AS SOON AS POSSIBLE as I m unaware of what to do.
Thank You.
Jayesh.
Ld counsels,
When will a case in family court proceed to the stage of enquiry. Once if the mediation fails, counters filed, after this there is a need to submit evidence. If the validity of the evidence is questionable will the court take the case for enquiry and start examinig witnesses. The pivotal issue in my case will be my consent for the marriage. Do I need to submit on oath that I gave my full consent for my marriage. I have already filed a restitution of conjugal rights.
Please clarify.
Dear Sir / Madam,

1) Deceased left behind his wife, son and three daughters. Two daughters are not married and one of them is handicap & elder daughter is expired leaving behind her three daughters Two of them married and one is divorcee who is now staying with her aunties.
2) Deceased has two Flats transfered by the Society in the name of his wife being a nominee. Now this building is going for re-devlopment, where members will get their shares of Corpus fund and Rent for hiring flat to stay during the period of construction.
3) One of the unmarried daughter has claimed that mother is not entitled for the corpus fund and rent paid by the builder as she is only trustee of the properties left by his father.
4) my query is what will be the legal position of the mother ? will she is entitled to get the fund from the society or she will get only 20% (1/5 )share of the property?
5) The three daughters of the deceased daughter are eligible for the share in the property?
Pls. advice and I thank you all in advance for your valuable guidance in the matter.
