Return of Plaint

Only the plaint is returned to the plaintiff
The court which returned the plaint says that the new court will call for the records with them.
The new court is asking to file the plaint along with the documents.
What should be done.
Any citations.

Insurance Cover in Gas Cylinder Explosion

There was an explosion of gas cylinder in a house ending two lives and injuring other three. I would like to know if there is any insurance cover on those cylinders or any other remedy should be availed.
Plz suggest me.

Purchase of plot through Power of attoney made by proprietor

Dear Sirs,

I am interested to purchase a plot in Jaipur (Rajasthan). The plot is owned by individual say "A" ( intially alloted by Jaipur Development Authority), wants to sale it to me but by drawing a power of attorney in favour of another individual say "B". In this transaction, the whole of the proceeds will go to "A". My query is :-

1. Is sale of plot / property through power of attorney valid in courts of law?

2. Is registration of the power of attoney drawn in favour of "B" be done beforehand sale transaction and registration of sale deed.What is the general stamp duty for such registration of power of attorney?

3. "A" is willing to be witness in the sale registration to be executed by "B". Inspite of this can future dispute be raised by "A"?

4. What can be the foolproof process where it can be checked that "B" has not done similar transaction of sale through power of attorney to some other individual/s ?

5. In the eyes of Law, the sale of a property which is registered will be considered genuine where another man who also claims right of property ( but which is not registered) of having been sold the same property by keeping the person in dark.

6. Is publishing a general enquiry in the newspaper about any claimant for plot is desired at the time of purchase and legally enough to protect one's interests ?

7. What general precautions should be taken for purchase and registration of purchased plot?

Service Tax

Dear All

We are executing Operating,Marketing and Technical services agreement with the Owner's of the property having Hotels.Under the agreement we are running the operations of the Hotel by placing General Manager and other managers of the department.Also the complete marketing support for Hotel is from our end.For this the Owner of the Hotel is paying a percentage of fees on gross operating income of the hotels monthwise.In the bills raised we are charging service tax.But the Owner's are disputing service tax as they were saying that the services are not leviable.Accordingly we have not deposit the service tax with the department.But now we have received notice from the department for payment of service tax.

Please advise whether we are liable to deposit the service tax or not.

PIL- Jurisdiction

hi,can somebody tell whether we can file a PIL into lower court. a NGO can move a pil in the form of Suit of declartion or anything if it found any illegility in goverment departments etc.plz help me


plz describe me in details as my case is this that one builder in collusion with MCD people got a contract sanctioned to build a school and the documents used by that builder are false and he even does not fulfilled the eligibility criteria. now i want to file a civil suit to get that contract illegal and void. so can i move before the civil court on behalf of a NGO who find all this. plz guide me it's urgent
