I am owner of a flat in Pune -PCMC. When I moved in to my flat, I used service of a movers and packers company.
In the entry gate, I approved the entry of the truck for unloading on my flat as the rule in almost any society.
After the truck unloaded my household items, while returning, the truck damaged a portion of the society gate.
The security could not stop the truck at that moment.
The the society management is of the view that I should pay for the gate repair.
Whereas I believe, the accident was done by a third party, and society if required should file case on the truck driver. Many third party delivery boys or service professionals keep coming inside the society. If someone indulges in some accident or criminal activity within the society without the knowledge of the flat owner, is the flat owner liable to such damages?
Hi ,Im residing in a cooperative society (registered),comprising of 10 flats total ,the issue is the managing comitee is negligent towards the society .It is not maintained properly ,the secretary doesnt stay in the same building but has rented his flat to a tenant, he doesnt entertain any complaints from members and threatens them of legal consequences if anyone complains to the dy registrar . Most of them are ill informed about the process to be followed .The society doesnt have security guard and some flats have persistent leakage problem ,one or two members told the secretary to look into this matter but hes least bothered to solve their problems .Kindly advise me what should i do so as to ensure a security guard in our society and also deal appropriately with the top floor leakage situation without getting into a legal battle . AND also advise me can he really take legal action against Dy registrars orders with society funds because thatll be a waste of money

I am Revathi from Coimbatore. Actually my father bought a condition Patta land in 1976 from the person who belongs to same community MBC. Now my father was dead on 2020. We are 4 kids for my father (3girls and 1 son and IM THE ELDEST). My father didn't teach us anything about agriculture and we don't know to maintain after my father's death. Is there any way that we can sell the land with proper registration. That land is the only means of everything for us. We have to sell the land in order to do my daughter's marriage and we are from middle class family. But all the buyers deny to buy the property as it is condition patta land. We were paying taxes without fail till the date. After my father's death we don't know what should we do to sell the land. Kindly please guide me with this. We have a paththaram on my father's name, only kai sitta is we are having. RSR form in my father's name.
Kindly please guide me what should i do to sell the condition patta land with proper registration. And can i sell the 2 acres of mine alone ?

My Parents purchased a site of 200 sq yards in the year of 2000 near Ramoji Film City, Hyderabad. We have all the documents with us and also EC is available on our name in the online sites. But we are unable to find the land physically. We reached out to officials on multiple occasions but they never gave us the required answer. We also reached a lawyer, he was discouraging us about the land and he asked to sell land to him for 2 lakhs which is not even 10-15% of the market value.
Can you guide us with your suggestions.

a amicable family settlement with out the intervention of the court among.the co shareholders of immovable property demarcating individual shares by metes & bound in writing ,and getting it registered Query does it amount to partition deed.

I had agriculture land in mp having survey no 3/2 few days back I was searching some case on rcms site so came to know about one order of SDM on dated 2-10-19 for Wajib ul arz passing order of way from survey no 1,2,3,4 based on letter from gram panchayat and patwari. Directing the patwari to mention the way in wajib ul arz based on map provided in file and put case in head B-121.
Here in above situation I had not been issued any notice nor informed me about the same and an order is passed by SDM for way. Though the land recorded in wajib ul arz is for way is not 3/2 but in map they had mentioned the same in my survey no. also in 2016 I had won the case before tehsildar stating that there is no way from my survey no.
So please guide me about the process to be followed by SDM before passing Order?
Remedies available to me or action need to be taken from on my side?

The goa law states that not more than 50% of the property can be disposed by way of "Will/Gift" by the testator.
Since the Goan law functions on communion of assets when 2 people get married. Hence, both the persons own 50% each of total assets.
Question 1: Here does disposable quota mean 50% of fathers/mothers share(i.e. 50% of their 50% share holding) or does it mean 50% of the total property(i.e. their entire share 100% can be disposed of by will individually)?
Question 2: If there are 2 houses and both the parents(father & mother) decide to make a "Will" stating House 'A' to one child and House 'B' to another child. Can any of the child challenge the will if any one feels the value of the house declared to be given to them in the 'Will' is of lower value.
Question 3: Can the property's declared in the will be excluded from collation?

I would like to let you know that I have filed the following civil cases as my father and my brother had cheated me of my hard earned money.

Honorable district court has granted my request and issued injunction against sale of our ancestral properties.
My father was thus forced into environment where he couldn’t sell the ancestral properties for his extravagant expenses.
He tried to intimidate me through the police for not being able to face the civil cases in the courts. I was told that my father has lodged a complaint claiming the maintenance and i need to appear for interrogation. Police SI and other officer were harassing me by contacting me on the phone every day. I was deeply disturbed by the series of crises they brought on a daily basis.
According to reliable sources i got information that my father was trying to get some confessions from me by force with the intention of annihilating my civil cases with the help of some well bonded police officers in police station.
I filed a OP in the high court regarding the police harassments and intervention in civil cases. Also i wrote a petition to the CM cell.
Responding to the CM cell petition the police assured that they would not interfere in civil cases and would not accept my father's fabricated cases.
Police harassment was some what mitigated due to the high court OP and CM cell petition.
The high court has recently directed the District Registrar to inquire my father's fraudulent registrations. In response to this he is again intimidating me through the police. They threaten me saying that they will take action under maintenance act if i don't allow to sell the properties.
In response i questioned below:
1.whether a father could claim care from his expelled.
2.Whether a father who enjoys income of nearly 40 acres of land could claim maintenance.
3.Whether a father could claim care from his unemployed son.
4.Whether a father could claim maintenance from his son who has filed money laundering cases against him.
Police refused to accept my argument and ordered me to appear for interrogation by next week.
Can the police take action against me dismissing the above arguments?
