Our society was formed in 2007 and conveyance was given in 2011. At that time builder paid the stamp duty amounting to Rs 1042000/-. As per the clause in registered agreements and conveyance deed the stamp and registration charges have to be borne by the society members but after almost 9 - 10 years the members are not ready to share the stamp duty saying that the issue has never been discussed in the meetings. When it is clearly mentioned in the documents are they not liable to pay the stamp duty as per their share.

FIR U/s 156(3) was registered and police after investigation filed cancellation report.. Now court to proceed u/s 200 crpc. My query is that FIR will stand cancelled. Court also ordered to examine complainant and witness if any. Will summons be issued to accused.

2. H S Parvathamma Alive – with 3 Male Children age 72 years as of 2015-Married 1956
3. S Revanasiddappa Died in 2004 at the age of 62 years – 3 Children (1 Male Expired) –Married in 1966
4. H S Nagarajappa Died in 1996 at the age of 51 years –Married in 1966-5 Childrens
5. H S Jayamma Died in 2012 at the age of 66 years-Married in 1959 5 Children (3 expired )
6. H S Heggappa Died in 2006 at the age of 59 years -5 Children Married in 1968
7. H S Sharadamma Married in 1966-Died in 2009 at the age of 60 years -4 Children

The male children of Late H Sanna Somappa i.e. H S Hanumanthappa,H S Revanasiddappa ,H S Nagarajappa and H S Heggappa made a Jubani Partikath (Partition ) in 1980 in schedule 1,2 and 3 (4 shares) leaving the female children . But the partition made in 1980 which is written as done in 1974 which is false. The document was prepared in 1980. It has been shown that HS Sanna Somappa was alive. It is false. It is mentioned that H Sanna Somappa signed the partition. Schedule 1 2 an3 were equally distributed among 4 male children of H S Sanna Somappa and Late Gangamma leaving 1acre 20 guntas for life maintenance ignoring the 6 female children.
This Jubani Parikath (Traditional Partition) was later registered in Sub Registrar Office Davanagere
Six female children of H Sanna Somappa and Gangamma file a civil suit in Davanagere Civil Court in 2010 and Judgement came in 2018 with a decree to distribute the 1/10th share for 4 female children of H Sanna Somappa and Gangamma out of their Life Maintenance Property only 20 Guntas . The court did not consider the remaining 1Acre. Actually l 1acre 20 guntas for life maintenance. This 1 Acre has been stolen by 4 male children of H Sanna Somappa and Gangamma.
Now the 4 male children of H Sanna Somappa and Gangamma are expired and their legal heirs sold few properties out of 56 acres.
My Request is there any possibility of getting the share for the Female children of H Sanna Somappa and Gangamma in schedule 1, 2 and 3 as per the recent Laws /amendments of Supreme Court in respect of Properties for female children.

The civil court did not accepted the will. The land is vacant and few old building are there in 4 guntas.
My Request is that is there any chance of cancelling the will and transfer the property in Joint names of 10 legal heirs of H Sanna Somappa and Gangamma.
I greatly appreciate your valuable opinion and advice/recommendations to go ahead for the Justice

I resigned my central gov job in june2017.
In 2019 I applied for EWS certificate for state gov job inwhich my family income of financial year 2018-19 was calculated .
In order to apply ews certificate I didn't find a place to mention my previous job salary or history .
Is there any problem .
One expert wrote that concealment of facts may harm bt I am confused that where to mention my last job history
My father had 04 children's. Before his death he made a registered will disinheriting 02 children from his property on the context that these 02 children do not take care of him and he likes the other 02 children more. In the will he has written that 1/2 part of all his property will go to child no 1 and other 1/2 part will go to child no -2. There is no specific details of property description in the will and the sentence used is all movable and immovable properties. My mother is attesting witness to it and is not a beneficiary in the will. The other witness to the will was an old illiterate lady who is no more alive. Can this registered will be challenged in any court of Law. If yes please guide where and how should I proceed.

We currently started a construction work in our house to enlarge the pre-existing windows by a little bit, but our neighboring Jain Temple's society is hindering in the work and threatening to put a wall over it, we just want better lighting in our home and have no ulterior motive, but they saying that it will affect their community as we will try to peek them, that is not true, the window being opened is at 8 feet of height, I am only 5'11 and my parents are shorter than me, and aren't capable of standing on stools to so called "peek" at their matters, we 3 members just want better ventilation in our crooked home, not to say that our house has been in this society for longer time than their temple and we have countless times endured because of them as they rent out this place for weddings or have community gatherings and they create a lot of noise even past midnight, I have to study for competitive exams but we never complained, all we want is just a little bit cooperation and they understanding that we are not violating any law as the window is on our side and not entering in their property. Mr A and B are two brothers having wife Mrs. X and Mrs. Y respectively. They have two partnership Firms.
One “A & co” having partners Mr. A and Mrs. Y. Another one is “B and co” having partner Mr. B and Mrs. X.
Both Firms took loans from a number of persons. Many of them filed cases against them also some cases u/s 138 N I Act , some for recovery of money suit under Order 37 CPC, some Regular Recovery Suits after the death of Mr. A on 30.07.2019.
Specific case:
Both Firms took loan from a lender of Rs. On lac each at different time through Cheque, and on the basis of post dated cheque of Firm signed by Mr. A for “A & co.” and by Mr B for “B & co. for each loan .
post dated cheques were dishonored in July 2021 reason being due
to stoppage of account operation due to death signatory/ partner.
Interest cheques were also given from time to time from the account of firm “A & co” signed by Mr. A from time to time after deducting TDS from interest amount till May 2019.

Now Development :
Development in the case is that on 30.07.2019, Mr. A expired.
About on 28.09.2029, A paper publication is given by which Mrs. Y retired from the Partnership of “A and co” on the basis of “Partnership reconstituted Deed dated 03.07.219” in which Mrs. Y retired on 03.07.2019 and Mr. B is inducted as new partner on 03.07.2019 notarized as S. no. 500A at Norary Register.
About on 28.09.2029, another paper publication is given by which Mrs. X retired from the Partnership of “B & co” on the basis of “Partnership reconstituted Deed dated 03.07.219” in which Mrs. X retired on 03.07.2019 and Mr. A is inducted as new partner on 03.07.2019 duly notarized as S. no. 500 B at Same Norary Register.
Mr. A expired on 30.07.2019.After his death, business ‘shop is almost closed, Partners do not want to meet Lenders and actually no sufficient fund in bank account.
Now
Thus in my view above both Partnership Dissolved on 30.07.2019 (because there were only two partner before death of Mr. A , if “Partnership reconstituted Deed dated 03.07.219” taken to be true or otherwise also)
1. Now cheque given in reimbursement of loan at the time of taking loan, presented and returned unpaid, whether in “ A & co”, Mrs.Y will be held liable or not u/s 138 N I Act.
2. Now cheque given in reimbursement of loan at the time of taking loan, whether in “ A & co”, Mr. B will be held liable or not u/s 138 N I Act as debt was taken before his entering in partnership.
3. Now cheque given in reimbursement of loan at the time of taking loan, presented and returned unpaid, whether in “ B & co”, Mrs.X will be held liable or not u/s 138 N I Act.
4. As per Notary Act, every document should be numbered serial. So it appears prima facie that “Partnership reconstituted Deed dated 03.07.219” was made after death of Mr. A and to absolve two ladies of family from the clutches of law. Can it be challenged on this ground,
3(a) if Partners can not prove it “genuine” can a case under IPC be filed,or 3(b) it should be disproved by lender for getting them punished in a case under IPC.
5. Can section 420 IPC alonghwith Section 138 N I Act be added as Firms has taken loan from a lot of persons, and not paying them after the death of Mr. A on 30.07.2019, as record was got from the official sight of Court?
