false 498a and 406 case

I got married in the year 2003.In the year march'2009 my wife has given a complaint to amritsar police to register a FIR against me under section 498a, 406. However police has given us a clean chit to us. Registered copy is available withus. Now my wife has moved into court and court has summoned us under section 498a and 406. She is asking for maintainence. please advice and guide.my email id is mehra73@yahoo.com

Futher she is also not attending section 9 hearing filed by me.riven

critaria to decide "decree with legal charges"

i have come across 1]decree granted WITH LEGAL CHARGES 2]without legal charges.Therefore i'm interested to know the legal aspect/rules governning this order.Is it DESCRETIONERY ORDER? if possible explain with reference to cases in co op courts/other courts in maharashtra.riven

visiting right

I was tortured and harassed emotionally, physically & financially by my husband.
I stayed with my parent’s through-out the pregnancy and even after. Now my son is 2 yrs old.
When my husband came to know that I'm not going to stay with him then he filed a divorce and wants visiting rights for 5 years.
I'm completely against the visiting right as he mentally disturbs me so much that I will not stop crying for many days. Even son is not ready to see him. He cries too much after seeing him.
Now I was wondering if somebody can suggest what I should do. Should I give visiting rights? In either case, he is not going out of my life. Do you think after 5yrs of visiting rights he can claim for custody of son? Just to let you know, they don’t have any boy in their family so for generation-sake they want this boy.
Unfortunately, my lawyer is not doing great job. And I can’t afford new lawyer to start from scratch.
Any suggestion is really appreciated.riven

compansation / interest for delay

Hi experts,

I seek your guidance that in Maharashtra State whether Builder is supposed to pay Interest / compensation for delay in his project ie delay in handing over possession of flat ?

Kindly also tell me GR / Notification / Rule in this regard

bail to an utp accused of s-376 IPC

An UTP detained for long and undergoing trial u/s-376IPC with several charge-sheeted witnesses is found to have been deposed by the victim girl that he is innocent and the accused is also ready to show that he has permanent residence and would not evade trial. whether the UTP should be granted bail or Court will wait till all the PWs are examind?riven

Total Number of Advocates in India

What is the total number of advocates presently working in India? any idea, sir?
How many law graduates pass out every year out of all law colleges of india?? And what percentage/number of them become Advocates?? Do you think controlling the number of people becoming Advocate by Bar Concil of India like CA/CS institutes would enhance quality and employbility amongst Advocates as large portion of them have no work, What do you think, Sir???riven

What determines seniority of an Advocate??Is it number of cases done or date of enrolement?? Number of cases won matters about seniority??How and when(after how much time) A fresh law gradute enrolled at bar would become a Senior Advocate??whether seniority at High court is diffrent from District Sessions court??Details please....riven

4...etc.
