Family property dispute

My father ( 73 years) & brother ( 45 years) jointly own a flat in Mumbai. Part payment was done by my father and brother took a loan for the balance amount . Does the amount of payment made by each party has any significance on ownership. The agreement does not state anything to this effect. The loan has now been repaid by brother. We are 2 sisters-myself ( 46 years ) unmarried & my sister ( 42 years) is married. My brother stays in the said flat with wife & children and my dad stays with me in a different flat which is owned by me. My mom has expired.

Below are some of my queries:

1. My father wants to sell his share but my brother is not willing to sell. Nor he is ready to buy father's share at market price. What recourse my father can take?

2. My father has not made any Will. In such a scenario how do I & my sister protect our share in the said flat. What steps we need to take to ensure our share is protected now and even after my father's death.

3. As it is a jointly held flat, what happens in the event of my father's death ? Does the ownership of my father's share get automatically transferred to my brother or he has to go through succession process whereby he would need our ( mine and my sister) permission to transfer my father's share to his name? Can succession certificate be requested by any legal heirs?

4. My father has nominated myself as the beneficiary of his share and this nomination is registered with housing society. Does it benefit me in anyway?

Me and my sister are keen to get our share in the flat even if we have to fight legal case against our brother.

Apply for ration card

Hi,

I recently got married. My wife name is not present in any ration card. All the three members of her family passed away. She used to stay on rent in mumbai. she has all documents except for ration and voter Id card.I intend to put her name in my family ration card. Can someone please help me regarding this.

Hindu marriage act

Respected Concern

My self Manoj. I have two queries as mentioned below.....

1. My one of friend has married with his mother's real sisters daughter(real mausi daughter) in Arya Samaj Mandir. Now they want to disclose this. Is this marriage valid according to Hindu marriage act or same is invalid. Please suggest.

2. Also one of my friend do same but relation is different. He has married with his Chachas daughter. Not real one. Actually their grandfather are real brothers. Means their grand grand father was one person. So is this marriage valid as same is falls under 3rd generation. Please help to resolve these two queries.

A vendor company send a legal notice.

hello,
i am owner of a company and we offer to our vendors for work on our project in different areas, one of our vendor had been failed to provide us a bank guaranty documents, so we didn't sign any agreement with them but they did some work for us and collect some amount from market too, but the amount they didn't deposit in company and misrepresent the customer. we stopped the work but they are asking for money of work, but in agreement we mention (which they not signed) that amount will be given after complete of work. now they send us a legal notice for that amount, what i need to do? suggest me.

Request for suggestion regarding getting risk cover of pnb met life insurance policy.

My father purchased a policy of PNB met life insurance in the year 2014 under the Risk cover Rs. 14 lacs. When purchasing the policy my father is illness condition and I do not know the agent has mentioned the illness in the proposal form. My father has paid three premiums and the due to illness they cannot pay the premium timely resultantly the policy has been lapsed for non payment of premium. After some time my father has passed away. The PNB Met life Insurance company is not ready to pay Full Risk Cover amounting to Rs. 14 lac and also not ready to pay the paid premium. I have requested time and again for providing full risk cover amounting to Rs. 14 lac. But the company refused to pay. Kindly suggest me what can I do to gain benefits of the risk cover. The company refuse to pay risk cover on the pretext that the policy of the deceased person has already been lapsed and the lapse policy do not cover any Risk cover amount. Kindly suggest what can I do.

[I have decree against injection order, when should I apply CAVEAT best way to apply for Caveat.]

In a civil suit Petitioner awarded perpetual injunction by Hon’ble. Under VII rules 1&2 R/W section 26 of civil procedure code.

I am the defendant, in the view of facts documents and circumstances of the case which I produced after hearing the arguments of both side, Hon’ble court dismiss the injunction order.

*Now the actual query is:--

I want to prevent the petitioner not to go for appeal for stay.

By apply Caveat. When should I apply CAVEAT best way to apply for caveat.

A serious question

(Repeated from general forum for the experts)
A simple but serious question:
Causing chaos and disruption in the parliament for any personal or political party issue shouldn't be a serious crime? when so many important policies and decisions in public interest are pending before the parliament needs to be discussed and argued and those are getting delayed because of this behaviour of our elected members of any political party..
