Dear Sir/ Madam.
As we are been discriminated and not being allotted burial land by local authorities. We are finding an option of buying a land of our own through the trust from our own funds. In Vasai East (Phalghar Dist. of Maharashtra).
Looking forward for your suggestion to how can we get the land if yes how do we go with it or are there any restrictions as per constitutional law.
For Govt BG we are in follow up with MC but in regard to buying a land for BG is there any constitutional law that stops us from getting a land

what do you mean by saying discriminated. Every city has its own master plan and the land is used as per that plan only. If municipality has spare land in the area marked for graveyard only then it may allot the land . No other land may be used for that purpose.

Sir,discriminated I mean de-focused to our voices and delay for more than 9 years for m which the follow is on... And to be precise our major concern is that in case we want to buy/purchase a burial land of our under the Church Trust than what is the Constitutional Law saying, whether can a Church Trust buy a land for burial from the Church funds for its dear and loved once or the Law does not permit owning a land for private burial under the church trust. This was the question we addressed in our query in the first mail even for which we are looking for an favourable reply.

Funeral Rites and Burial customs are a person's private matters. Every person has a right to follow his will.

Refer the cases of Mr.Tulsi Gaur an Retired IAS officer in Ghaziabd who buried his wife's body in his residential plot .The objections were over ruled.

First buy the property in the name of the Church Trust and then you could allocate or convert the same for burial. Ensure proper compound walls etc is made for this.Even in Mumbai you could find many Cemetery of various religions in between the Residences.

Burying one of the members of your family in your house may be one's private matter but using the land as a graveyard is altogether different. This require permission under the master plan of the city according to permitted land use.
