LCI Forum Members,
I'm a facing 498a charges.
Case still on going.
Query:
My call for records of cell can be taken/collected by private investigator.
Is it so easy in india to get call for records of my calls, by a private investigator.
Getting call for records of my calls, is not invasion of privacy.
How to contest private investigator.
Please enlighten.

Even if you are guided for contesting the private investigator, in which way this will be helpful in your 498a case? Come with full facts, so that some guidance can be given to you.

Dear Members,
@ Sainath & Ajay Sirs,
Probability...
i mean, that the complainant might have appointed Private investigator to get my call for details as there is no one else who need my call for details.
@ Malipeddi Jagga Rao Sir,
My query is ..
1) contesting private investigator is to know whether he is genuine or not.
2) Is there no law for privacy in personal matters as it is a family dispute.
3) A Private Investigator has such accessbility.

The private investigator's report on such incidences cannot be considered as admissible evidence until the court has called for it through such agency. The private investigators are to have registered themselves for the purpose with the government to be recognised. Further this being a state prosecuted case, what is the necessity to provide the evidences by he defacto complainant before the court at this stage when it has not produced the same before the police at the time of lodging the complaint or during investigation by police. this can be objected to and get it rejected, discuss with your lawyer.
