Can advocate appear before the sci without aor

(Querist) 30 December 2013 This query is : Resolved
Sir,
I m trail court advocate and fighting case of relative ( WHO IS POOR PERSON) who has received notice for Transfer petition ( Civil) Divorce petition. The notice of hearing clearly states that Respondent could file the affidavit either in person or through Advocate on record ..I drafted his reply and filed his reply ( as party in person) after obtaining letter of Authority..Now the date of hearing has been coming..Since I am not the AOR , Can I appear and argue on the behalf of relative after filing the vakaltnama on record..??Will SCI allow me to argue without having AOR
T. Kalaiselvan, Advocate (Expert) 31 December 2013
I think even now the practice n SC if that an advocate on record is only eligible to appear and argue, please consult the SC bar association for further details.
Dr J C Vashista (Expert) 31 December 2013
The Advocate-on-Record has to oversee the procedural part of the petition to reduce administative work of SC registry and not the reply. You can file reply and appear.
Devajyoti Barman (Expert) 31 December 2013
You can always appear and argue/plead the case but without filing vaklatnama through AOR it is not possible.

U CAN APPEAR AND ARGUE UR CASE IN SCI BUT U WILL HAVE TO FILE VAKALATNAMA AND AFFIDAVIT BY AOR.

agree with expert, Mr. Nanda
yogesh (Querist) 31 December 2013
Thanks for experts reply but Dr J C Vashista Sir has pointed out that for reply sign of AOR is not required..whether AOR is only meant for filing the case and not for reply
yogesh (Querist) 31 December 2013
I saw the fromat of vakaltnama "order 4 rule 18" there is "Vakaltnama" and "Memo of apperance" whether it means I will ahve to sign the Memo of appearance if Vakaltnama has signed by AOR in order to tender my appearnce on behalf of party
Dr J C Vashista (Expert) 01 January 2014
Mr. Yogesh,
Contact registry in SC with the vakalatnama signed by the party and appear in the court on the date fixed, even the party can appear in person.
I wish happy new year to all members and visitors
