Can court not give mark documents to party?

Respondent has applied to get registered copy of documents filed by applicant in family Court. After reading application of requesting registered copy, the staff person of court told to respondent that Court can give only regd. copy of ‘list of documents’ as it is EXHIBIT documents and not give regd. copy of ‘the documents’ as they are MARK documents.
Que: Is it rule of Court that Court can give only registered copy of EXHIBIT documents only and not give registered copy of MARK documents to parties?

You have mistaken. Exhibit documents and marked documents are one and the same.

At the time of filing case, the party will file list of documents. At the time of evidence, these documents are marked by the judge in the presence of party and otherside counsel. Sometimes the otherside counsel may object particular document to mark, then the court will not mark that document. These are called unamrked documents.

If you apply for marked documents, you will get easily. But regarding unmarked document, the court will not permit to give certified copy. If you want unmarked documents, then you have to file a petn to return the unmarked docments.
