Can new owner build house as per map approved by last owner

I bought a plot in Ghaziabd, GDA scheme in May 2016. One of the Previous owner got the MAP approved from GDA for builidng house in year 2008. My query is to know that may i build house as per MAP get approved by one of the previous owner.
Please let me know.

Myself not from your state. So there are chances that I may make mistake as exact rule I have not read.

1) In general case Plan is valid for 1 year and If you don't do construction within that period then you need to inform Town Planning authorities and they renew Plan as per latest construction law .

2) Duration may change from state to state but 2008 is very old . Myself almost certain construction rules may have changed here and there and the permission is also automatically ceased.

3) Liability of Arch. ,Structure Engineer , etc. too is for limited time . So that too may have ended

4) Under all circumstances I feel you require to renew the building permission 99%

You can construct a building with previous sanction of plan approval by the previous owner if the approval letter falls within the limitation period/renewal periods.

If the approval is barred by limitation, again you have to apply for the fresh sanction of approval for building construction.

In your case it is better to consult the Town Planning Dept, to verify the validity of the approval taken in 2008. If it is valid, go ahead with the construction otherwise apply for the new one on your name.

In Maharashtra there is some restriction that when permission is given to one person it can not transferred to other because builder take permission then give POA etc. to other and that dummy person does illegal construction (name sake) and builder tries to take immunity that he is innocent. So many local bodies have put restriction that such transfer of permission is invalid.

Person have to renew the permission and it is done on same terms and condition without additional development charges (Tax which is imposed in Maharashtra) , But change of builder or person who do construction they have to imitate else it is invalid

You may apply for revalidation of the approved plan, if it is barred by limitation then you can get a new plan drafted as per your choice and get it approved.
