Sura 4:3, which permits polygamy only if the husband may treat each wife equitably. But Sura 4:129 says this equal treatment is impossible. Therefore, polygamy was impossible in practical terms.Yet it exists. Marrying another without consent of existing one may confer upon her right to stay away from husband and yet claiming maintenance on the ground of discrimination of treatment. Only Quran would apply and i think there is no legislation asking muslim husband not to marry second during pendency of litigation in court with existing one.
