Can we directly approach supreme court or high court

(Querist) 10 April 2023 This query is : Resolved
Dear Sir/Madam,

Is there any provision to appeal directly to the Supreme Court or High Court for the reopening of a criminal case that was closed around 20 years ago? The person was molested, and police tried to convince him not to press charges during that time. He left the city and was untraceable. Now he has been traced. If possible, then please guide me through the process.
Can we file a writ petition?
Regards!

Sir, the incident happened with a friend of mine. That time I was also in college and could not do much, now I learned about my friend's where-abouts and spoke to him about reopening the case. He was not much inclined, but upon my request he said ok and asked me to find the procedure and accordingly he will give his final consent.

It depends upon the police report prepared at that time. If he was declared untraceable you can contact the local police and get him arrested and tried for the offences, if not time barred. In serious cases case reopening is easy.

You cannot approach high court or supreme court without exhausting the remedies available locally.

You are still evading the material facts.

Was a FIR registered at that time? If so, what is the status of the said FIR?
