Can we take stay on land distribution done by my grandfather?

(Querist) 17 July 2016 This query is : Resolved
Dear Sir\Madam,

We live in Muzaffarnagar (U.P.). In my family we having Grandfather and he is having 5 sons (including my father). There is a shop in my parental village which is in the name of my Grandfather. My father was working with my grand father since he was young ( since ~18 years old) and now he is at age of 55. This land\shop was bought after my father started working with him as people do work in combined family. Whatever he earned, he gave to my GrandFather. In recent course of action, my grandfather registered the shop\land in the name of 2 younger uncle. Do my father having any right to stop this action?

you can try. The facts given give an impression that your father was taken as unpaid servant and he can even demand arrears of salary gratuity etc.

Ntowthstanding above you stated that

"This land\shop was bought after my father started working with him as people do work in combined family."
Other side of coin.

It gives impression that your father was earning and not your grandfather. still the shop was purchased in grandfather's name. Other party can argue this to be his self acquired property.

Your father did not purchased shop in his own name if he was earning and law basicaly has no remedyu for stupidity.

The title owner ( Grandfather) has already registered the property in name of 2 uncles.

Visit a very able counsel with whatever record you have for a considered opinion, merits, options, if any.

If the property was purchased in the name of your grandfather, he can gift / sell / mortgage / bequeath it in favor of any son. Other sons can not object.
