dear sir
Rehabilitation council of india (RCI), a statutory body under the ministry of social justice and empowerment, GOI has passed certain order to conduct a bridge course for professionals registered under it and working for the welfare of peoples with the physical disability. some group or association may take a legal stay over this order with their own motive. we as prospective students for this bridge course or our association are planning to file a caviate in the court before they approach to court for any legal stay. my query is --- to which court we approach first to file this caviate -delhi high court or any other session/civil court. OR how the opposite group may proceed --via high court or session court to take a legal stay. as the RCI is located in delhi the jurisdiction pertains to delhi.please guide me ,its urgent.

dear praveen, it is caveat, not caviate... any way... you can lodge your caveat before the court by impleading the opposite party as a non caveator. District court is to likely to be approached by them..

If any civil proceeding is to be filed by the opposite party the other party applies to the court to give notice to him by the opposite party.

What is your apprehension where you want to file caveat (for moving to court by other party) is not clear to me?

Whether some interested party have already applied/obtained injunction?

Sir my quarry is : if any one want to take a legal stay against any notification issued by a govt. Body then he/she will approach to district court or directly high court to get the legal stay. And with this apprehension if we file a caveat then it should be filled in which court---district or High court OR in all the district courts in jurisdiction and High court as well. Because we are not sure in which court the opposite party will approach to get a legal stay.
