Cbi case - prevention of corruption act

(Querist) 05 June 2013 This query is : Resolved 
Complaint for demanding bribe was lodged with CBI and the CBI has filed a case under prevention of corruption Act but subsequently under RTI Act in respect of the complainant the accused has obtained information regarding long criminal/police record (for about 10 years before and after the year of case). Kindly opine as to what should be the fate of this case in view of celebrated principles of the judiciary that the person knocking the doors of the court must himself first come with clean hands.

Past cases, if of different nature, of the complainant would not have any bearing with the present case, unless the cases were of similar nature and would have proved false ultimately during trial.

The theory of clean hands is relevant in the same case. The past criminal history of the complainant definitely create a doubt in the mind of the court and it can definitely bring the case under reasonable doubtful but this cannot become the sole ground to get relief in the given case.
