AFTER LAPSE OF 2 MONTHS ,NO DATE OF INQUIRY HAS BEEN FIXED.CAN I SUBMIT MY DEFENCE BY SPEED POST?
Guest (Expert) 12 September 2012
Lapse of what, whether after appointment of I.O. & P.O., or after submission of the POs brief on conclusion of departmental inquiry? There is a set procedure of departmental inquiry. Any haste can prove fatal for you, if defence is not called for.

So, be clear at what stage is your Rule 14 case at present.

You are free to do anything you wish, if you are really interested to spoil your own case in hurry by revealing your defence strategy well before the prosecution completes its case.

Do you think, with your brief info any body can guess what happened after issue of charge sheet to the CO, specifically during the five inquiry dates, who ordered the CO to submit defence even prior to the completion of departmental inquiry, what are the latest orders of your inquiry officer either for the P.O. or the C.O. on the last inquiry date, why the PO is not able to get and submit the additional documents, what your own defence assistant has suggested you, whether there are any witnesses in the case or not, why you are interested to submit your defence before deposition by and cross-examination of the witnesses?

If you want proper advice, you must state the position clearly with appropriate background, without expecting the experts to ask you for additional information every time you write something in piecemeal.

If you want to understand proper procedure and stages of departmental inquiry, you may better hire services of some expert on service laws, if your defence assistant is not capable to guide you properly.
