This query is : Resolved
A friend of mine expired recently leaving appx.5 lacs in his public provident fund account with Indiapost . The account matured earlier & is extended without fresh sub- scription. My friend has registered 3 nominees against this account(Wife,Son & Daughter). There is no will.My queries are -
1. As nominees live at different locations ,can they submit claims for payment of respective shares separately ? Indiapost is insisting that all nominees file claim together .This is not practical as one nominee is unable to come for next few months .Please advise correct rules. REGARDS

Thanks indeed for quick advice .However I feel there is no such written rule or notification which states that all nominees need to file claim together . I shall be thankful if someone could give reference of such written rules . Regards

The Sub/Postmaster may ask the claimant(s) to sign in his/her presence.
Let the interest accrue in a/c and all nominee's may claim in one go.

In the nomination form whether the account holder has mentioned the % of share to be given to each nominee after him? In absence of such clear mandate, Post office is justified in asking all nominees to come together and claim.

If you say that there are no written rules to sit your taste, you may have to look for one by writing to the postal authorities who will give a reply in writing after which you can decide what is to be done further on the issue.

The rules are available on websites and RTI route can also be pursued.
There is well explained escalation matrix too.

You have to show a rule to the Postmaster under which you can compel him to pay without presence of other nominees.

PPF account cannot be split in to three parts. All the nominees have to appear personally, claim jointly, prove their identity, and get the amount sanctioned in their name, sign the acquittance in lieu of payment having been received according to their individual shares, as nominees.
If you feel there is no such written rule or notification which states that all nominees need to file claim together, convince the P.O.
Otherwise, if one nominee is unable to come for next few months, rules cannot be relaxed for him. India Post has necessarily to follow the prescribed rules and regulations of the schemes.

Mr. Din Dayal,
Why not correspond directly with the concerned P.O. to get authentic reply?
Although, your query was considered merely an academic query, but still I replied you stating what is what of the provisions. But don't expect me to provide solution to your school exercise.
Even if you are a consultant, as per your profile, please don't try to make profits out of my replies in the guise of your own advice to your client.
Read appropriate law and rules, if you are not interested in writing to the concerned postal authorities or file a case against them, if not satisfied with the reply of postal authorities.
